Software Beta Test and Candidate Release

Terms and Conditions

Definitions

  • You, Participant — any person(s) involved with downloading, installing, or using the beta test software or software release candidate.
  • We (our) — P.I. Engineering or its selected representatives.
  • Beta Software — Software released “as is” without warranty for the sole purpose of testing and evaluation.
  • Beta Test — The release of beta software by P.I. Engineering for the sole purpose of testing and evaluation.
  • Agreement — The acceptance of the terms and conditions outlined for a beta test or candidate release.
  • Participation — The act of downloading, installing, or using the beta test software or software candidate release.
  • Hedgehog — A small insectivorous mammal of the family Erinaceidae covered with dense erectile spines and frequently referenced in image and word on P.I. Engineering hidden flaps, installation discs, and applications.
  • Software Release Candidate — Software released for final testing with the potential for becoming the final product, less the discovery of a critical bug.
  • Candidate Release — The release of a software release candidate by P.I. Engineering for final testing before the software is approved for final release.
  • System — The hardware and software that controls and comprises the beta software or software release candidate test environment.
  • Peripheral — Any attached device used to enhance or control the system including, but not limited to, X-keys devices, mice and keyboards.

Nature of Agreement

Beta software offered to participants of a beta test is not generally open to the public, and should not be used in a production environment. The beta test will be conducted with the sole purpose of evaluating and testing the beta software before its release to the general public.

Software release candidates offered are generally open to the public, and should not be used in a production environment. The software candidate release will be conducted with the sole purpose of testing for critical bugs before the final version of the software is approved and released.


Updates and Changes

P.I. Engineering reserves the right to update or change the software at our own discretion, with or without prior notification to any or all participants.
P.I. Engineering also reserves the right to change the terms and conditions of a software beta test or software candidate release at our own discretion, with or without prior notification to any or all participants.

Participants who agreed to a previous version of the terms and conditions must also agree to any subsequent changes made to the agreement, or immediately cease and terminate any further participation in the beta test or candidate release.


Disclaimers and Limitations of Liability

By participating in a beta test or candidate release you affirm your understanding that beta software and/or software candidate releases are provided “as-is” and that they are offered solely for testing and evaluation purposes. P.I. Engineering offers no warranties express, implied, or otherwise as to the accuracy or performance of the software released for beta testing or as a part of a candidate release.


By participating in the beta event or candidate release you concede that all damages resulting from downloading, installing, or using the beta software or software release candidate are the sole responsibility of the participant(s), and that P.I. Engineering is released from all liability. These damages include but are not limited to loss in profits, damages to your system, or damages to your system peripherals.


Termination of Agreement

Participation in a beta event or candidate release without full agreement to the terms and conditions for the event is strictly forbidden. Participants who do not accept the terms and conditions of the beta test or candidate release must immediately cease and terminate any further participation in the beta test or candidate release.

Your participation in the beta test or candidate release is strictly voluntary, and you may terminate your rights to participate in the beta test or candidate release at any time.
P.I. Engineering reserves the right to terminate the rights of a participant at any time with or without prior notification. P.I. Engineering also reserves the rights to terminate a beta test event or candidate release at our own discretion, with or without prior notification to any or all participants.
